Our Story

Hikmah Syarie began as a small chamber practice in Putrajaya, founded by advocates who had spent years watching families approach Syariah proceedings without a clear sense of what to expect. The courts are not unfamiliar to most Malaysians in principle — but the procedural detail, the state-by-state variation in enactments, and the intersection of Syariah and civil jurisdiction are rarely well understood outside of practice.

Our founding purpose was simple: to stand alongside the person who has just received difficult news about a marriage, an inheritance, or a custody arrangement, and to help them see — plainly and without pressure — what the law makes available to them, and what the realistic pathway looks like.

Over the years, the practice has grown to cover the three main non-criminal areas of Syariah law where individuals most often need considered professional support: family matters (including Sulh mediation, divorce, and nafkah), Faraid estate planning and Wasiat drafting, and full representation before state Syariah High Courts and Subordinate Courts. Each of these is handled by advocates admitted as Peguam Syarie — a qualification specific to Syariah court practice and distinct from civil bar admission.

The name Hikmah — wisdom in Arabic — reflects both an aspiration and a method. We take time with each matter. We read the applicable state enactment carefully. We tell clients what we see, not what we think they want to hear. And we keep the atmosphere of our consultations as calm and measured as the subject matter allows.

Syariah law in Malaysia operates through a parallel court system established under state religious legislation. The Federal Constitution reserves jurisdiction over Islamic personal law to the states, which means that the enactments governing divorce, custody, maintenance, estate distribution, and religious conversion differ from state to state. For practitioners, this requires maintaining working familiarity with multiple legislative frameworks and their respective court practices.

Non-criminal Syariah matters — the jurisdiction within which Hikmah Syarie operates — cover family law proceedings, estate and inheritance matters, and civil applications concerning Muslim individuals. Family proceedings include fasakh (judicial dissolution of marriage), divorce by taklik (conditional divorce), nafkah (maintenance) for wives and children, hadhanah (custody), mut'ah (consolatory payment), and the division of harta sepencarian. Estate matters span the formal Faraid distribution scheme, the drafting of Wasiat within the permissible one-third limit, Hibah as an alternative estate planning instrument, and the application for Sijil Faraid from the Syariah court.

The practice of a Peguam Syarie requires both substantive knowledge of fiqh as applied in Malaysian statutory form and procedural competence before the Syariah court hierarchy — from the Subordinate Court to the High Court, and if required, the Syariah Court of Appeal. At Hikmah Syarie, every client file is handled by an admitted Peguam Syarie, with continuous attention to the applicable state enactment and the local court's current practice.
