Family Law
Fasakh and harta sepencarian — cross-state matter
Challenge
A wife sought fasakh, but the marriage was registered in a different state from where the couple had lived for the past eight years. Assets included an apartment registered in the husband's name only but purchased jointly during the marriage.
Approach
We identified the appropriate court jurisdiction, filed the fasakh application, and simultaneously prepared a harta sepencarian claim supported by documentary evidence of joint contribution — bank records and communication records relevant to the property purchase.
Outcome
The court granted the fasakh and awarded a share of the harta sepencarian to the wife following a case management hearing where the respondent did not contest the evidence presented. The matter resolved within six months of filing.
Estate Planning
Multi-asset estate — Faraid, Wasiat, and civil Grant of Probate
Challenge
A family came to us following the death of a father with assets spanning property held under a civil title, unit trust investments, and a business interest. The children were from two marriages, which complicated the Faraid calculation.
Approach
We applied for the Sijil Faraid at the Syariah Court and simultaneously coordinated with a civil solicitor for the Grant of Probate. We prepared the Faraid share calculation and assisted the family in understanding each beneficiary's entitlement across asset classes.
Outcome
Both the Sijil Faraid and the Grant of Probate were obtained. Distribution was completed without family dispute, partly because we had taken time early on to explain the entitlement of each beneficiary — including the children from the second marriage — in a way the family accepted as fair and in accordance with Islamic principle.
