Things people often ask

Which state Syariah court has jurisdiction over my matter?
Syariah law in Malaysia is legislated at state level. Jurisdiction generally follows the state in which the marriage was registered or where the parties are domiciled. For cross-state matters — for example where spouses reside in different states — we help determine the appropriate court and any procedural steps to establish jurisdiction.
What is the Sulh process and do I have to use it?
Sulh is the mediation stage built into the Syariah court process. For family matters, many state enactments require an attempt at Sulh before a case proceeds to full hearing. It is a structured but informal session — both parties meet with a Sulh officer to explore whether an agreed resolution is possible. We walk you through what to expect before you attend.
How is harta sepencarian (matrimonial property) divided in Syariah proceedings?
Harta sepencarian refers to assets jointly acquired during marriage. The Syariah court has discretion to divide these assets based on the respective contributions — direct financial contribution, indirect contribution such as homemaking, and other relevant factors. This is separate from Faraid inheritance distribution and applies during divorce proceedings.
Can a Wasiat override Faraid shares?
No. Under Islamic inheritance law, a Wasiat (bequest) may only direct up to one-third of the estate, and it may not be made in favour of a person who is already a Faraid heir. The remaining two-thirds (at minimum) is distributed by Faraid to eligible beneficiaries according to the prescribed shares. Hibah (lifetime gifts) is a separate mechanism with different legal treatment and timing considerations.
What happens at an initial consultation — do I need to commit to filing?
Not at all. The purpose of a first consultation is to understand your situation and provide a clear picture of the legal landscape and likely procedural pathway. You are under no obligation to engage us further. Many clients find that a single session gives them enough clarity to decide how to proceed — whether with us or otherwise.
Do you handle matters involving both Syariah and civil courts?
Yes. Some matters — such as civil property ownership that intersects with a Syariah divorce, or estate assets requiring a Grant of Probate from the civil High Court alongside a Sijil Faraid from the Syariah Court — involve both jurisdictions. We coordinate these parallel processes and advise on the appropriate sequence of applications.
